The terms of using BookWave

Terms of service

These terms set out the rules for using BookWave and explain the responsibilities we share while creating your audiobooks.

Your agreement with us

These Terms of Service govern your access to and use of BookWave’s websites, applications, audiobook-generation tools, and related services. By creating an account, purchasing a service, or otherwise using BookWave, you agree to these terms.

If you use BookWave on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

Eligibility and accounts

You must be at least 13 years old and legally able to enter into a binding agreement to use BookWave. If you are under the age of majority where you live, a parent or legal guardian must approve your use.

You are responsible for providing accurate account information, safeguarding your credentials, and all activity under your account. Tell us promptly if you believe your account has been compromised.

Your content and permissions

You keep all rights you hold in books, manuscripts, cover art, instructions, and other materials you upload, as well as in the audiobook output generated for you. You grant BookWave a limited, worldwide license to host, copy, process, modify, and transmit your content only as needed to operate, secure, and provide the service.

You represent that you own your content or have all permissions needed to upload it and create an audiobook from it. BookWave does not grant you rights to third-party books or other protected material. You are responsible for determining whether your use complies with copyright, privacy, publicity, and other applicable laws.

Acceptable use

You may not use BookWave to:

  • violate law or another person’s rights;
  • upload content you do not have permission to use;
  • create deceptive impersonations or misleading synthetic media;
  • distribute malware or interfere with the service’s operation;
  • bypass access controls, usage limits, or payment requirements;
  • reverse engineer or extract non-public portions of the service; or
  • use automated methods to access BookWave without our permission.

We may remove content or restrict activity that we reasonably believe violates these terms or creates risk for users, BookWave, or others.

AI-generated audio

BookWave uses artificial intelligence and third-party processing services to generate narration. Output may contain pronunciation, pacing, formatting, or other errors. You should review generated audio before publishing, distributing, or relying on it.

We do not guarantee that output will be unique, error-free, suitable for a particular purpose, or free from similarities to content created for others. Availability of voices and processing features may change.

Payments and subscriptions

Prices, credits, and included features are shown before purchase. Payments are processed by Stripe. You authorize us and our payment processor to charge the payment method you provide for purchases, applicable taxes, and recurring subscription fees.

Subscriptions renew automatically at the stated interval until canceled. You can cancel through your account’s billing portal; your access continues through the end of the paid billing period. Except where required by law or expressly stated at purchase, payments are non-refundable and unused credits have no cash value.

BookWave property

BookWave and its licensors own the service, including its software, design, branding, and other materials, excluding your content. Subject to these terms, we give you a limited, personal, non-exclusive, non-transferable, revocable right to use the service for its intended purpose. Feedback you provide may be used without restriction or compensation to you.

Suspension and termination

You may stop using BookWave at any time. We may suspend or terminate access if you materially breach these terms, create legal or security risk, fail to pay amounts due, or if we discontinue the service. Where reasonable, we will provide notice and an opportunity to address the issue.

Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will continue to apply.

Disclaimers

To the fullest extent permitted by law, BookWave is provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these terms excludes warranties that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, BookWave and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from your use of the service.

Our total liability for all claims relating to the service will not exceed the greater of $100 or the amount you paid BookWave during the 12 months before the event giving rise to the claim. These limitations apply only to the extent permitted by applicable law.

Changes and contact

We may update these terms as the service changes. If a change is material, we will provide reasonable notice. By continuing to use BookWave after updated terms take effect, you agree to the revised terms.
